Can You Claim Insurance If Car Windscreen Smashed Due to Double Parking?

Can You Claim Insurance If Car Windscreen Smashed Due to Double Parking?

Double parking is when you park in the street next to a car already parked in a parallel parking space.

Double parking occurs because the provided parking spaces are insufficient for demand, thus becoming a norm, especially in congested areas.

Finding an empty parking space may be troubling. Some people are in a rush, so they double park their cars. In return, they leave a number on the dashboard in case he needs to move his car.

However, you cannot double park, whether you leave a number or not. Double parking is not legal anywhere in Malaysia. You will be liable for a fine sum of at least RM300. In worse cases, you’re liable under Section 48 (1) of the Road Transport Act 1987 – which means you’ll be slapped with a fine of up to RM5,000 or a minimum jail term of 12 months, or both.

Why are you not allowed to double park?

Double parking can cause inconveniences such as:

    • Traffic congestion
    • Disputes among road users
    • Block the other vehicles
    • Possible crash
    • Disturb the pedestrians and disabled groups (OKU)

Can you claim insurance if your windscreen is smashed due to double-parking?

Yes, you can claim insurance. However, it depends on the outcome of the police report.

You must file an Own Damage Claim under your policy if you are found guilty. However, please note that your NCD will be affected as you are the at-fault party.

If you find your car windscreen smashed due to double parking, do a police report and inform your insurer for assistance.

    1. Submit your car to the panel workshop. You may call your insurance hotline number for confirmation.

    2. Fill up the claim form at the workshop. Ensure to inform them that you are filing a claim from your insurer.

    3. After the repair, you can take your car home. You do not have to pay the windscreen cost if you claim insurance.

However, should the police investigation finds you to be innocent, the third party has to cover your car repair cost under their policy. You can file a Third Party claim without affecting your NCD rates!

*Note: The third-party refers to the individual who smashed your windscreen.

    Double-parking? Here’s the right way

Double parking is not illegal. But if you must, park your car properly without causing inconvenience to others.

    Have common sense.

    1. Display your phone number on the dashboard
    2. Set the gear to Neutral (N)
    3. Release the handbrake

Don’t be self-centred! Have tolerance towards other road users as well.
