Is BJAK Shariah-compliant?

What does Shariah-compliant mean in insurance?
Functionally, both takaful and conventional insurance protect you from financial loss, but they differ in concept, structure and benefits.
| Feature | Takaful | Conventional insurance |
|---|---|---|
| Core concept | Mutual protection. Participants pool contributions to support one another | Risk transfer. You pass your risk to the insurer |
| Underlying principle | Ta'awun (mutual assistance) and tabarru' (donation) | A commercial contract between insurer and policyholder |
| Prohibited elements | Structured to avoid riba, gharar and maisir | No Shariah restrictions apply |
| Fund ownership | Participants own the fund collectively | The insurer owns the premiums once paid |
| Surplus sharing | Surplus may be distributed back to participants | Profits belong to the company and its shareholders |
| Investment strategy | Shariah-compliant instruments only | No Shariah restrictions |
| Role of the operator | Manages the fund on participants' behalf, for a fee | Carries the risk, pays the claims, keeps the profit |
| Eligibility | Open to everyone, regardless of religion | Open to everyone |
Key terms
- Riba — interest. Any guaranteed return on money itself. Takaful funds avoid interest-bearing instruments, both in how contributions are held and how they are invested.
- Gharar — excessive uncertainty. A contract where key terms or outcomes are unclear to one party. Scholars identify this in conventional insurance because you pay a fixed premium for a payout that may never come. Takaful addresses it by treating your contribution as a donation to a shared fund rather than a purchase of an uncertain payout.
- Maisir — gambling. Gaining at someone else's expense on a chance outcome. The concern is the win-or-lose shape of a conventional policy: claim and you gain, do not claim and your premium is gone. Risk-sharing removes that framing, because the fund belongs to participants either way.
- Ta'awun — mutual assistance. The founding principle of takaful. Participants agree to help one another from a shared fund, rather than each buying protection individually.
- Tabarru' — donation. The portion of your contribution given into the shared risk fund. Because it is a donation rather than a payment for a service, the transaction is not a sale of something uncertain.

Who determines Shariah compliance?
The Shariah status of any product is determined by the underlying takaful operator — as well as other licensed Islamic Financial Institutions (IFI) — and its appointed Shariah Committee under Bank Negara Malaysia's Shariah Governance Framework, subject to the overriding authority of BNM's Shariah Advisory Council (SAC).
| Role | Who | What |
|---|---|---|
| Product oversight | The takaful operator's Shariah Committee | Advises on and oversees the Shariah compliance of that operator's products and operations |
| Governing authority | Shariah Advisory Council (SAC) of BNM | Highest Shariah authority for Islamic finance in Malaysia. Validates takaful products. Its rulings override any other Shariah body in the country |
| Distribution and aggregation | BJAK | Displays and distributes the product. Determines nothing about its Shariah status |
The SAC was established in 1997 and sits under section 51 of the Central Bank of Malaysia Act 2009. Every licensed takaful operator must maintain its own Shariah Committee under BNM's Shariah Governance Policy Document.
How does BJAK help customers make an informed choice?
BJAK displays available quotes with explicit labelling to distinguish takaful operators from conventional insurers side by side.
- Enter your details — vehicle and personal information, used to retrieve quotes from participating providers
- Quotes are displayed — each quote shows the provider name and whether it is takaful or conventional
- You compare — coverage, add-ons, excess, sum insured and price, side by side
- You choose — BJAK does not make binding recommendations. The selection is yours
- The operator issues — the e-policy or e-cover note comes from the insurer or takaful operator you selected
What should customers verify before buying?
Customers should review their vehicle and policyholder details, provider identity, Product Disclosure Sheet, coverage type, optional add-ons, excess terms and sum insured structure before completing payment.
| Check | Where | Why |
|---|---|---|
| The operator | Named on the quote | Confirms who you are contracting with, and that they are licensed |
| Product type | Labelled on the quote | Takaful and conventional appear together |
| Product Disclosure Sheet | Available before payment | Sets out coverage, exclusions, excess and fees |
| Certificate and policy | Issued by the operator | These are the actual contract |
| Sum insured | On the quote | Affects both your premium and any payout |
| Payment method | At checkout | The product and how you pay for it are separate. Instalment terms need reviewing on their own |
